We are very familiar with the various means of resolving your divorce without going to trial. Whenever possible, we will work diligently to reach a settlement that fulfills your goals through direct negotiations with the other party's counsel. In addition, when you contact us at Randal A. Three Distinct Methods of Resolving Issues Out of Court

Depending on your unique circumstances, there may be substantial benefits — in privacy, cost-effectiveness, and efficiency, for example — to resolving disputed issues in your divorce through one of the following methods:

Arbitration. Both parties and their legal counsel must agree to present their cases and abide by the decisions of a certified divorce arbitrator. Attorney Randal A. Lowry is a certified family law arbitrator and will with your to resolve your case given your particular. The entire process can be carried out in a private setting, rather than a public courtroom, and the result can be dramatically faster, more efficient resolution than in a trial. Mr. Lowry has represented numerous clients in arbitration hearings.

Mediation. Divorcing couples who are confident in their ability to work with a mediator and resolve disputed issues rationally may choose this method of avoiding litigation. Often, this is chosen as a cost-effective alternative to going to trial. However, no binding decisions are issued and, if mediation breaks down, either party can still take the case to court. Attorney Marisa Lowry is a certified family law mediator.

Collaborative Law. In this approach, each party is represented by his or her own attorney in direct negotiations, without an arbitrator, mediator or judge present. Although both sign an agreement to abide by decisions made through the collaborative law process, it is still possible for the case to go to court. If collaborative law discussions fail to resolve issues, both parties are required to find new counsel for any litigation.
