Mediation in Divorce Matters

Mediation can be a very useful tool to facilitate the settlement of a divorce. A mediator is a neutral, third-party that is very experienced in the field of family law. The mediator will meet with the parties for as long as the parties are willing to continue on with mediation. If the parties come to an agreement, then the mediator will put the agreement into a memorandum of understanding. 

Once the parties come to an agreement in mediation, the parties will need an attorney to draft a separation agreement. A mediator cannot draft a separation agreement for the parties. Generally, each party will obtain their own counsel to finalize the divorce. 

Mediation can be a useful tool for the right parties. Mediation can become costly if it lasts for several sessions and the parties cannot come to a resolution. If mediation is unsuccessful, then the parties will be forced to litigate the divorce.
